Washington, Sept 6 (ANI): Lindsay Lohan's lawyer has filed papers to quash all or a part of a negligent driving suit that stems from a two-year old car crash.
Raymundo Ortega has sued the actress for 200,000 dollars in damages for ramming into his car in October 2005.
Ortega had claimed that the actress was drunk when the incident took place.
However, Lohan's counsel Alfred Gerisch said that Ortega has accused the actress of driving while drunk to force a settlement.
"These are nothing but inflammatory statements. The mere presence of this type of allegation in the complaint is an attempt to embarrass [Lohan] with false allegations in order to use it as a battering ram to force a settlement," E! Online quoted Gerisch, as stating.
Ortega's lawyer Robert G Klein filed papers stating that the judge must take into account that Lohan checked into rehab shortly after the crash.
"The fact that Ms. Lohan was admitted to rehab for alcohol abuse shortly after this accident raised a presumption that at the time of his accident he was under the influence," Klein stated.
He added that after the crash, Lohan hid in a retail store instead of seeing if Ortega required 'medical attention'.
"Instead of seeing if Mr. Ortega needed medical assistance, Lindsay Lohan fled the scene and took refuge in a retail store," Klein stated.
A hearing has been scheduled for September 11. (ANI)
